Clarification about CARES Act Notice to Vacate
Last week, an article from the National Apartment Association titled “Fannie and Freddie End CARES Notice Enforcement” was shared.
The article addressed the decision by Fannie Mae and Freddie Mac properties to end enforcement of compliance with the CARES Act 30-day Notice to Vacate requirement.
The wording in the article may have been interpreted to mean that CARES Act properties are no longer required to provide a 30-day notice to vacate. This is not the case.
The change referenced is administrative in nature. It pertains to loan documentation, tenant communications regarding CARES Act protections and renter assistance programs, and enforcement of penalties at affected properties.
Although the update may appear to eliminate the CARES Act 30-day notice to vacate requirement, the CARES Act itself remains unchanged and fully in effect. The National Apartment Association continues to advocate at the federal level for changes to this requirement. Updates will be provided if any developments occur.
