ICYMI: SB 38 Goes into Effect January 1, 2026
SB 38, a law enhancing due process and removing longstanding barriers that have made eviction proceedings unnecessarily slow, unpredictable, and costly for property owners, was signed into law by Governor Abbott in 2025.
This legislative victory brings important changes to the eviction process and to several legal forms used during the leasing process. It is essential that all property owners, operators, and onsite staff understand these updates. Please note: these changes do not go into effect until January 1, 2026.
The Texas Apartment Association has created several educational resources to help you understand how SB 38 will affect your operations.
